Terms of Service

Last updated: 23 October 2026

These Terms of Service (“Terms”) are an agreement between you and James McDonnell, an individual doing business as Insurance Tracker, with his principal place of business in La Cañada Flintridge, California (“we,” “us,” or “our”). They govern your access to and use of the Insurance Tracker service (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

PLEASE READ SECTION 8 CAREFULLY. IT REQUIRES MOST DISPUTES BETWEEN YOU AND US TO BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT, AND IT WAIVES YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. YOU MAY REJECT SECTION 8 WITHIN 30 DAYS OF FIRST ACCEPTING THESE TERMS, AS DESCRIBED IN SECTION 8.9.

1. Description of Service

Insurance Tracker is an administrative tracking and information tool that allows authorized users to organize and view insurance-related information. Insurance Tracker is not an insurance company, agent, or broker and does not issue, bind, place, renew, modify, extend, cancel, reinstate, or guarantee insurance coverage. All coverage, renewal, reminder, and related disclaimers in the Coverage, Renewal and Reminder Disclaimer are incorporated into these Terms.

Tracking only

Insurance Tracker is record-keeping software. It is not an insurer, agent or broker, and nothing in it is insurance, legal, or risk-management advice. Policy and certificate information is entered or uploaded by users and their brokers. We do not verify that any policy is in force, that coverage is adequate, or that any certificate is accurate. A certificate of insurance is not an insurance policy and does not amend, extend or alter the coverage afforded by the policies listed. Confirm coverage directly with the issuing insurer or broker. Expiration reminders are a convenience and may fail; you remain responsible for your own insurance and contract requirements.

Insurance quotes

Insurance quotes and services are provided by Knight Insurance Services, CA License #0K11401, 1327 Foothill Blvd, La Cañada Flintridge, CA 91011, (818) 662-4200. Shaun Gailey, CA License #0F13255. Insurance Tracker is a software platform, is not an insurance agency or broker, and does not sell, solicit, or negotiate insurance.

Asking for a quote or a renewal quote is optional. What is shared with Knight Insurance Services, and when, is described in our Privacy Policy.

2. Eligibility and Accounts

Access is by invitation only. You must be authorized by the applicable company or portal administrator. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You represent that you have authority to enter into these Terms on behalf of yourself and any organization you represent.

Who else can see your company’s records. The portal operator, James McDonnell, can view any company’s records to run and support the service. An insurance agency linked to a company can view that company’s records and work on its renewal quotes. Unless the company admin sets “Your broker can” to View only, the agency’s agents can also edit the company’s records. Company admins choose this setting and can change it at any time.

When you first sign in or activate your account, you are asked to confirm that you accept these Terms, and you are asked again when we publish a new version. Accepting these Terms, or continuing to use the Service, means you accept these Terms, including the arbitration agreement and the class action waiver in Section 8.

3. Acceptable Use

You agree not to misuse the Service, including by attempting unauthorized access, interfering with the Service, uploading unlawful or harmful content, or using the Service in violation of applicable law or insurance licensing requirements. You remain solely responsible for the accuracy of information you enter and for independently verifying all insurance-related details with official documents, your licensed agent or broker, and the applicable insurer.

4. Intellectual Property and Data

We retain ownership of the Service and related intellectual property. You retain ownership of the content you upload or enter. You grant us a limited license to use, store, and process that content solely to provide and improve the Service.

Uploads. If you upload a document or a photo, you are responsible for having the right to upload it and to share it with the other people who can see your company’s records. That includes photos of people: make sure you have any permission the law requires before you upload a photo that shows a person.

5. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED. WE ARE NOT RESPONSIBLE FOR ANY LAPSE IN COVERAGE, MISSED DEADLINE, INACCURATE REMINDER, OR OTHER DAMAGE ARISING FROM USE OF OR RELIANCE ON THE SERVICE. OUR TOTAL LIABILITY ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM (OR $100 IF YOU PAID NOTHING), EXCEPT FOR LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

6. Termination

We may suspend or terminate access at any time for any reason. You may stop using the Service at any time, and you may delete your account at any time: see How to delete your account. Upon termination, your right to access the Service ends. Provisions that by their nature should survive (including disclaimers, limitations of liability, data ownership, and the dispute resolution and arbitration agreement in Section 8) will survive.

7. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except that Section 8 is governed by the Federal Arbitration Act. Subject to Section 8, any dispute that is not resolved by arbitration shall be brought in the state or federal courts located in Los Angeles County, California, and you and we consent to personal jurisdiction and venue in those courts, except where prohibited by law.

8. Dispute Resolution and Binding Arbitration

8.1 Agreement to arbitrate. In this Section 8, “Dispute” means any dispute, claim, or controversy between you and us arising out of or relating to these Terms, the Service, or any relationship between you and us, whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory, and whether it arose before, during, or after these Terms ended. Except for the matters described in Sections 8.2 and 8.3, you and we agree that every Dispute will be resolved by binding arbitration on an individual basis, and not in court and not before a jury.

8.2 What stays out of arbitration. Either party may (a) bring an individual claim in small claims court, in any venue that has jurisdiction, for as long as the claim stays in that court and on an individual basis; and (b) ask a court for injunctive or other equitable relief to stop actual or threatened infringement or misuse of intellectual property. Nothing in these Terms prevents either party from reporting conduct to, filing a complaint or charge with, participating in an investigation by, or seeking relief from any federal, state, or local government agency, including the California Department of Insurance.

8.3 Public injunctive relief. Nothing in this Section 8 waives, limits, or prevents you from seeking public injunctive relief in any forum. A claim for public injunctive relief is severed from arbitration and must be brought in the courts described in Section 7. If you bring both a claim for public injunctive relief and a Dispute subject to arbitration, the arbitration proceeds first and the court claim is stayed until the arbitration ends, unless the court orders otherwise.

8.4 Notice of Dispute and informal resolution. Before starting an arbitration, the party raising the Dispute must send a written Notice of Dispute and give the other party 30 days to resolve it. You send your notice by email to james@ccrehomes.com or by mail to 4281 Palm Drive, La Cañada Flintridge, CA 91011; we send ours to the email address on your account. The notice must state the sender’s name, the email address on the account, a description of the Dispute, and the relief sought, and it must be signed by the person bringing the Dispute. Both parties will make a good-faith effort to resolve the Dispute during those 30 days. Any applicable limitations period is paused while that effort is under way. Neither party may begin an arbitration before the 30 days have passed, and either party may ask a court to enforce this requirement.

8.5 Arbitration rules and arbitrator. The arbitration is administered by the American Arbitration Association (AAA) before a single arbitrator. If you use the Service primarily for personal, family, or household purposes, the AAA Consumer Arbitration Rules apply; otherwise the AAA Commercial Arbitration Rules apply. In either case the rules apply as modified by this Section 8, and this Section 8 controls where they differ. The rules are available on the AAA website at adr.org or by calling AAA at 1-800-778-7879. The arbitrator must be a retired judge or an attorney licensed in California. If AAA is unavailable or declines to administer the arbitration consistent with this Section 8, the parties will agree on a substitute administrator, or either party may ask a court to appoint an arbitrator under 9 U.S.C. § 5.

8.6 Fees, hearing, and location. For any arbitration you begin, we will pay all AAA filing, administrative, and arbitrator fees, except that if the arbitrator finds your claim frivolous or brought for an improper purpose, those fees are allocated under the applicable AAA rules. Each party otherwise pays its own attorneys’ fees and costs, and we will not seek our attorneys’ fees or costs from you unless the arbitrator finds your claim frivolous or brought for an improper purpose. Nothing here limits either party’s right to recover fees or costs where a statute provides for them. You may choose to have the arbitration decided on documents alone, by telephone or video conference, or at an in-person hearing in the county where you live or where your principal place of business is located, or at any other place the parties agree on.

8.7 INDIVIDUAL BASIS ONLY. YOU AND WE AGREE TO BRING A DISPUTE ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY AWARD RELIEF ONLY IN FAVOR OF THE INDIVIDUAL PARTY SEEKING RELIEF, AND ONLY TO THE EXTENT NEEDED TO PROVIDE RELIEF WARRANTED BY THAT PARTY’S INDIVIDUAL CLAIM. THE ARBITRATOR MAY NOT CONSOLIDATE OR PRESIDE OVER ANY CLASS OR REPRESENTATIVE PROCEEDING UNLESS BOTH PARTIES AGREE IN WRITING.

8.8 The arbitrator’s authority and the award. The arbitrator has exclusive authority to resolve any Dispute, including any question about the interpretation, scope, applicability, enforceability, or formation of this Section 8, except that a court, and not an arbitrator, decides any question about the enforceability of Section 8.3 or Section 8.7. The arbitrator may award any relief a court could award on an individual basis under applicable law, including statutory damages and attorneys’ fees where a statute provides for them. The arbitrator will issue a written decision stating the essential findings and conclusions. The award is binding only between you and us, has no preclusive effect in any other arbitration or proceeding, and may be entered as a judgment in any court with jurisdiction.

8.9 Your right to reject this Section. You may reject this Section 8 by emailing james@ccrehomes.com or writing to 4281 Palm Drive, La Cañada Flintridge, CA 91011 within 30 days after you first accept these Terms, or within 30 days after we notify you of a material change to this Section 8. Your notice must state your name, the email address on your account, and that you reject the arbitration agreement. Rejecting this Section 8 has no effect on the rest of these Terms and no effect on your access to the Service. If you reject it, Section 7 governs any Dispute between you and us.

8.10 Changes to this Section. If we materially change this Section 8, we will email the address on your account at least 30 days before the change takes effect. The change will not apply to any Dispute of which either party had already given written notice under Section 8.4 before the effective date. You may reject the change as described in Section 8.9.

8.11 Severability and survival. If any part of this Section 8 is found unenforceable, that part is severed and the rest of this Section 8 stays in effect. If Section 8.7 is found unenforceable as to a particular claim or request for relief, that claim or request is severed from arbitration and brought in the courts described in Section 7, and the remaining claims are arbitrated. This Section 8 survives the end of these Terms and the closing of your account.

8.12 Federal Arbitration Act. This Section 8 involves interstate commerce and is governed by the Federal Arbitration Act, 9 U.S.C. §§ 1 et seq.

9. Changes

We may update these Terms. We will post the revised version with an updated date, and we will ask you to accept the new version the next time you sign in. Continued use after the effective date constitutes acceptance where permitted by law. Changes to Section 8 also follow Section 8.10.
