Coverage, renewal and reminder disclaimer

Insurance Tracker is an administrative tracking and information tool designed to give clients a convenient, user-friendly way to organise and view insurance information. Insurance Tracker is not an insurance company and does not issue, bind, place, renew, modify, extend, cancel, reinstate, or guarantee insurance coverage.
No responsibility for renewals
Insurance Tracker does not assume any responsibility or duty to monitor, manage, obtain, negotiate, place, or complete an insurance renewal. Insurance Tracker does not guarantee that a policy will be renewed, that renewal terms will be offered, that premiums will be paid, or that coverage will remain in force.
Responsibility for managing insurance and renewal activity remains with the client and the client's licensed insurance agent or broker, as applicable. Each client is responsible for reviewing their insurance documents, tracking expiration and renewal dates, paying premiums, responding to requests for information, and communicating directly with their agent, broker, or insurer. Each agent or broker remains responsible for their own professional and legal duties. Use of Insurance Tracker does not transfer, reduce, replace, or create any such duty, and Insurance Tracker does not assume the duties of an agent, broker, insurer, claims administrator, or other insurance professional.
Courtesy reminders are not guaranteed
Any email, alert, notification, calendar entry, expiration date, or renewal reminder provided through Insurance Tracker is offered solely as a courtesy and for general convenience. Reminders are not guaranteed to be created, scheduled, sent, delivered, received, accurate, complete, or timely.
A reminder may be delayed, duplicated, inaccurate, filtered as spam, sent to an outdated address, blocked by an email provider, affected by a system or internet outage, or not sent or received at all. Insurance Tracker has no duty to verify that a reminder was sent, delivered, opened, understood, or acted upon.
Reminder emails are configured for each user individually, per company, and can be switched off at any time under Tasks & renewals, then My email reminders. Turning reminders off, or leaving them on, does not change any of the responsibilities described in this disclaimer.
Clients and insurance professionals must maintain their own independent calendars, records, and follow-up procedures. No person should rely on Insurance Tracker, an Insurance Tracker reminder, or the absence of a reminder as the sole means of tracking a policy expiration, renewal, premium, cancellation, nonrenewal, claim, notice, or other deadline.
No effect on coverage or deadlines
A missing, delayed, inaccurate, or undelivered reminder does not renew or continue coverage, extend a deadline, prevent cancellation or nonrenewal, excuse a late payment, change a policy term, create a grace period, waive an insurer's rights, or create insurance coverage that does not otherwise exist.
Official insurance documents control
Information displayed in Insurance Tracker may be entered by clients, agents, brokers, insurers, administrators, or other sources and may be incomplete, delayed, or out of date. The official policy, declarations, endorsements, binders, notices, invoices, and insurer records control over any summary, date, status, document, or reminder displayed in Insurance Tracker.
Clients should verify all material information directly with their licensed agent or broker and the applicable insurer. Insurance Tracker does not determine whether coverage is adequate or appropriate and does not provide insurance, legal, tax, financial, compliance, or risk-management advice.
Not a claim or notice channel
Unless expressly stated in a separate written agreement, uploading a document, entering information, or sending a message through Insurance Tracker is not notice to an insurer, agent, broker, claims administrator, employer, benefit plan, or other third party. Insurance Tracker should not be used to report emergencies, submit time-sensitive claims, request policy changes, cancel coverage, or deliver legal notices. Users must follow the contact information and procedures contained in the official insurance documents.
Limitation of responsibility
To the maximum extent permitted by law, Insurance Tracker is not responsible for any lapse, cancellation, nonrenewal, missed deadline, loss of coverage, uninsured or underinsured loss, increased premium, denied claim, lost opportunity, or other damage arising from or related to a reminder that was missing, delayed, inaccurate, not sent, or not received; information that was incomplete or out of date; or reliance on the Insurance Tracker service instead of direct verification and independent follow-up.
Nothing in this disclaimer excludes a right or liability that applicable law does not permit to be excluded.
Disputes and arbitration
Everyone who uses an Insurance Tracker account accepts the Terms of Service, which require most disputes with James McDonnell, an individual doing business as Insurance Tracker, to be resolved by binding arbitration on an individual basis rather than in court. Accepting those Terms waives the right to a jury trial and the right to take part in a class, collective, or representative action.
The arbitration agreement does not limit the right to seek public injunctive relief, to bring a qualifying claim in small claims court, or to report conduct to or file a complaint with a government agency, including the California Department of Insurance. James McDonnell pays the arbitration filing, administrative, and arbitrator fees for an arbitration an account holder begins, and an account holder may reject the arbitration agreement within 30 days of first accepting the Terms. Section 8 of the Terms of Service sets out the full terms, including how to reject it.
